Child custody investigations happen to be the second most common type of domestic investigations that we perform (first being infidelity). This type of investigation usually involves situations in which one parent has full custody and the other parent wants full custody or shared custody. It may also involve cases in which both parents share custody and the client may want full custody. Our primary job in this type of investigation is to gather information that would prove that the subject parent is either neglecting or abusing the child or that they are an unfit parent. Showing that a parent is unfit usually involves proving that the subject is using alcohol irresponsibly or using drugs. It may also involve other types of behavior that may put a child at risk, such as speeding or violating other traffic laws, failing to use use an age-appropriate car seat for the child, leaving the child with family when they asked the court for one-on-one time with the child, etc.
Another common type of child custody investigation involves one parent taking the child from another state and bringing them to Florida, without the other parent’s consent. These types of cases are a bit more difficult because they involve locating the parent with the child (and they are usually hiding) and maintaining surveillance on them while the client goes to the appropriate court in Florida to domesticate the pick-up order. Once the order is domesticated, the police is usually called to the location to serve the order, while the client stands by to pick up the child. This process involves a lot of coordination between our agency, the client, the client’s attorney and the local police department. Fortunately, we have done hundreds of similar cases and consider ourselves experts in this type of case, so we are able to guide our clients throughout the entire process.
Most of the evidence that we gather during a child custody investigation is usually through surveillance. Our investigators follow the subject parent for a few days (in order to establish a pattern) and obtain as much video footage as physically possible. Once the evidence is obtained, it is compiled in a report format and submitted to the client’s attorney. It is important to note that we usually work very closely with the clients’ attorneys during these types of investigations, to ensure that the evidence gathered is sufficient to prove the case.
